RPGGen makes no guarantees about the Platform or Services at this time, including but not limited to, features, uptime, or usability. The Platform may change at any time and the company holds no responsibility for issues or losses caused by this.

By accessing or using the Platform, you acknowledge that you have read, understand, and agree to be bound by these Terms, whether or not you are a registered user of rpggen.com. If you do not agree to these Terms, then you must not use our Platform.

General Conditions

We reserve the right to refuse service to anyone for any reason or no reason, at our sole discretion, at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform, use of the Platform, or access to the Platform or any contact on the Site through which the Platform is provided, without express written permission of RPGGen.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Privacy

All personal information RPGGen collects on the Platform is subject to the Privacy Policy posted on the Platform, which is incorporated as part of these Terms by reference. By using the Platform, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

Intellectual Property Rights

The Platform contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, graphics, written content, product design, product images, and product descriptions. No portion of the materials on the Platform may be reprinted, republished, modified, or distributed in any form without the express written permission of RPGGen. You may not, and this Agreement does not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, or create derivative works with respect to the Platform or any Services available therein.

Certain content may be licensed from third parties and all such third-party content and all intellectual property rights related to the content belong to the respective third parties. The names, logos and taglines that identify any RPGGen Products or Services are proprietary marks of RPGGen. All other trademarks and service marks reproduced in the Platform, which are not the property of, or licensed to the operator, are the property of their respective owners and are acknowledged on the website.

If you believe your intellectual property rights have been infringed upon, please notify us through the procedure found on our DMCA page.

Prohibited Uses

Use of the Platform

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Platform.

You may not use our Platform or Services for any illegal or unauthorized purpose nor may you, in the use of the Platform, violate any laws in your jurisdiction (including but not limited to copyright laws).

You agree to provide RPGGen with true, accurate, current, and complete information about yourself and your company when such information is requested by RPGGen. Your use of the Platform and Services and participation in these features is conditioned on the provision of such information.

All Information you provide for account registration, to complete a transaction through the Platform, or otherwise is governed by our Privacy Policy. You consent to all actions RPGGen takes with respect to your Information, consistent with our Privacy Policy.

Login Credentials

You are responsible for maintaining the confidentiality and security of your account username and password ("Credentials"). You are responsible for all uses of your account and Credentials, regardless of whether authorized by you.

User accounts are non-transferable, and all users are obliged to take appropriate measures to prohibit unauthorized users from accessing the Platform using their Credentials. You agree to notify RPGGen of any unauthorized access to or use of your account or breach of your Credentials. RPGGen reserves the right to disable or suspend your Credentials at any time for any or no reason and at its sole discretion, including if RPGGen determines, in its opinion, you have violated any provision of the Terms.

User Conduct

You agree not to:

  • Abuse, harass, threaten, or intimidate others
  • Post or transmit any content that is obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party
  • Post content that contains homophobia, transphobia, ethnic slurs, religious intolerance, or encourages criminal conduct
  • Attempt to impersonate another user or person
  • Post any illegal or unauthorized content or use for any illegal or unauthorized purposes
  • Post or transmit any communication or solicitation intended or designed to obtain password, account, email address, or private information
  • Post, upload, transmit, share, or store unsolicited or unauthorized advertising, solicitations, "spam", or any other type of unauthorized solicitation
  • Solicit personal information from any user under the age of 18
  • Violate any laws in your jurisdiction (including but not limited to copyright laws and laws regarding online conduct and acceptable content)
  • Post advertisements or solicitations of business
  • Remove, circumvent, disable, damage, or otherwise interfere with security-related features of the Service, Platform, or content
  • You may not modify, publish, transmit, reproduce, scrape, create derivative works from, distribute, perform, adapt, aggregate, sell, transfer, or in any way exploit any of the content on the Platform, in whole or in part
  • Use any robot, spider, site search, and/or retrieval application, or other device to scrape, extract, retrieve, or index any portion of the content
  • Create an account with an email address you do not own
  • Create any more than a single account

You further agree:

  • To only use the Platform in a manner consistent with these Terms of Use and in compliance with applicable laws and regulations
  • To maintain the confidentiality of any password(s) associated with your use of the Platform
  • To notify the company immediately in case of any unauthorized use of your account
  • Not to intentionally block, remove, or otherwise obstruct the proper functioning and view of advertisements, and/or user interface and functionality
  • Not to upload, post, email, transmit, or otherwise make available any material that contains software viruses, or any other computer code, files, or programs designed to interrupt, destroy, limit the functionality of, or enable unauthorized access to any computer software or hardware or telecommunications equipment
  • Not to upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
  • Not to use any robot, spider, scraper, or other automated means to access the Platform
  • Not to forge headers, manipulate source identifiers, or otherwise attempt to disguise the origins of any content made available via the Platform

You will not:

  • Take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure
  • Interfere or attempt to interfere with the proper working of the Platform or any activities conducted on the Platform
  • Bypass any measures we may use to prevent or restrict access to the Platform, including robot exclusion headers

Accuracy Of Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information for all purchases made on or through the Platform. You agree to promptly update your account and other information, including your email address, and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Modifications to the Platform and Prices

Prices for the Platform and any Services offered thereon are subject to change without notice.

We reserve the right at any time to modify or discontinue the Platform, (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Platform.

User Submissions

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RPGGEN OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. RPGGEN DOES NOT AND CANNOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless RPGGen and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Platform or Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Platform (or any part thereof).

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on the Site or in respect to the Platform constitutes the entire agreement and understanding between you and us and govern your use of the Platform, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

You agree and affirm that you will be bound for jurisdiction and venue purposes to the laws of the State of Wyoming and that any claim against RPGGen shall be filed in the Circuit Court of Sheridan County, Wyoming without giving effect to any principles of conflicts of laws. All disputes arising under or related to these Terms and/or your use of the Platform or any Service shall be resolved exclusively through mandatory arbitration rather than by court proceedings. Such arbitration shall be held in Sheridan, Wyoming. No party to this Agreement will challenge the jurisdiction or venue provisions as provided in this section. Nothing contained in this section shall prevent us from obtaining an injunction against any act or omission, anticipated or otherwise, on your part.

YOU AND RPGGEN AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PLATFORM OR SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION OCCURS. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
